1. SCOPE AND CONTRACTING PARTY
These Terms & Conditions apply to purchases made through the online store operated by:

Throughout these Terms, “ESVlife”, “we”, “us” and “our” refer to ESVlife e.U.
These Terms apply to all contracts concluded through our online store unless otherwise expressly agreed.
Mandatory statutory consumer rights remain unaffected by these Terms.
2. USE OF OUR ONLINE STORE
You may use our online store only for lawful purposes.
When placing an order, you must provide accurate, complete and current information necessary to process and fulfil your order.
If you create a customer account, you are responsible for keeping your login information confidential and for preventing unauthorised access to your account.
Consumers who have not yet reached the age required to conclude a legally binding contract may place orders only with the consent of their legal representative where required by law.
3. PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, images, quantities, ingredients, prices and other information presented in our online store are accurate.
Minor differences in colour, appearance or packaging may occur due to screen settings, production changes or packaging updates, provided that these differences do not materially alter the agreed characteristics of the product.
The product information displayed at the time of your order forms part of the contractual information where required by law.
Please follow the instructions, recommended use, storage information and warnings shown on the respective product page and product packaging.
Food supplements are foods and are not intended to replace a varied and balanced diet and a healthy lifestyle.
We reserve the right to discontinue products or change our product range for future orders at any time.
4. CONCLUSION OF THE CONTRACT
The presentation of products in our online store does not by itself constitute a legally binding offer to conclude a purchase contract.
By completing the checkout process and clicking the button that clearly indicates an obligation to pay, you submit a binding offer to purchase the products contained in your order.
After receiving your order, we may send you an automatic acknowledgement confirming that your order has been received. Such an acknowledgement does not by itself constitute acceptance of your offer unless it expressly states otherwise.
A contract is concluded when we expressly accept your order, confirm dispatch of the goods, or dispatch the goods, whichever occurs first.
We reserve the right to decline an order where there is a legitimate reason to do so, for example where:
• a product is unavailable;
• payment cannot be authorised;
• information provided with the order is materially incorrect;
• there is an obvious pricing or technical error;
• delivery to the requested destination is not available; or
• there is reasonable suspicion of fraud or unlawful activity.
If we do not accept an order for which payment has already been collected, the relevant amount will be refunded without undue delay.
5. ORDER INFORMATION
Before submitting your order, you will have the opportunity to review and correct the information entered during checkout.
Please check your order carefully before submitting it.
After the order has been submitted, changes or cancellations may no longer be possible if processing or dispatch has already begun.
This does not affect any statutory right of withdrawal or other statutory consumer rights.
6. PRICES, VAT AND PAYMENT
The price applicable to your purchase is the price displayed during checkout at the time you place your order.
Prices displayed to consumers include applicable value added tax (VAT) where required by law.
Shipping costs and any other additional charges payable by you will be clearly displayed before you submit your order.
For deliveries outside the relevant customs or tax territory, import duties, customs charges or local taxes may apply where permitted by law. Where such charges are not collected by us during checkout, they may be payable by the recipient to the competent authority or delivery provider.
Available payment methods are displayed during checkout.
Payment processing may be carried out by third-party payment providers. Their own terms and privacy information may also apply.
You must be authorised to use the payment method selected for your purchase.
7. PROMOTIONS AND DISCOUNTS
Promotional codes, discounts and special offers may be subject to additional conditions communicated together with the relevant promotion.
Unless otherwise stated, promotions cannot be combined.
We may correct an obvious pricing or promotional error before a contract is concluded.
Nothing in this section limits rights already acquired under a validly concluded contract.
8. SHIPPING AND DELIVERY
Available delivery destinations, shipping methods and applicable shipping costs are displayed in our online store or during checkout.
Any stated delivery period is calculated in accordance with the information provided during checkout and applicable law.
We will make reasonable efforts to deliver within the stated delivery period.
If delivery is delayed, your statutory rights remain unaffected.
For consumer purchases, the risk of accidental loss of or damage to the goods generally passes to you when the goods are delivered to you or to a third party designated by you who is not the carrier.
If you independently commission a carrier that was not offered by us as a delivery option, statutory rules regarding the transfer of risk apply.
Please ensure that the delivery address provided with your order is complete and correct.
9. FAILURE OR DELAY OF DELIVERY
If delivery cannot be completed because the delivery information provided by you is incorrect or incomplete, we may contact you to arrange further delivery.
Any additional costs caused by circumstances for which you are responsible may be charged to you to the extent permitted by law.
This does not affect your statutory consumer rights.
Where delivery is delayed or impossible for reasons outside our reasonable control, the applicable statutory rules apply.
10. RIGHT OF WITHDRAWAL AND RETURNS
Consumers may have a statutory right to withdraw from an online purchase.

Our voluntary return policy does not limit statutory consumer rights.
11. ONLINE WITHDRAWAL FUNCTION
Where applicable, consumers may submit a withdrawal declaration electronically through our “Withdraw from contract” function.
After the withdrawal declaration is submitted using the confirmation function, an electronic confirmation containing the submitted withdrawal information and the date and time of receipt is sent to the email address provided.
The online withdrawal function is an additional method of exercising the right of withdrawal and does not restrict other methods permitted by law.
12. SUBSCRIPTIONS
Some products may be offered on a recurring subscription basis.
Where a subscription is offered, the relevant price, billing frequency, delivery frequency, minimum duration where applicable, renewal conditions and cancellation information will be displayed before the subscription order is submitted.
By purchasing a recurring subscription, you authorise the recurring payment method selected during checkout to be charged in accordance with the subscription conditions presented to you before purchase.
Future subscription renewals may be cancelled in accordance with the cancellation options and conditions communicated when the subscription was purchased.
Cancellation of future subscription renewals is separate from the statutory right of withdrawal relating to an order that has already been placed or delivered.
Nothing in this section limits statutory consumer rights.
13. GIFT CARDS
Gift cards offered through our store are subject to the conditions stated on the relevant product page and at the time of purchase.
Statutory consumer rights remain unaffected.
Gift cards may not be exchanged for cash except where required by law.
14. STATUTORY WARRANTY RIGHTS
Consumers are entitled to statutory warranty rights in accordance with applicable law.
For consumer purchases of goods governed by the Austrian Consumer Warranty Act (Verbrauchergewährleistungsgesetz – VGG), ESVlife is liable for defects that exist at the time the goods are supplied and become apparent within the statutory warranty period.
The statutory warranty period for goods is generally two years from delivery.
Your statutory warranty rights are independent of our voluntary return policy and any commercial guarantee that may be offered.
Nothing in these Terms excludes or restricts statutory warranty, conformity or other consumer rights.
15. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS
If you receive a product that is damaged, defective or different from the product ordered, please contact us at:

Please provide your order number and, where useful, photographs or other information that helps us identify the issue.
We will handle the matter in accordance with your statutory rights.
You are not required to rely on our voluntary return policy in order to exercise statutory warranty rights.
16. PRODUCT SAFETY
Products must be used and stored in accordance with the information and warnings provided on the product packaging and product page.
Do not use a product after its applicable expiry or best-before date where doing so would be inappropriate.
If a product is subject to a safety notice or recall, we may contact affected customers using the contact information available to us where legally permitted or required.
17. INTELLECTUAL PROPERTY
Unless otherwise stated, the content of our website, including text, product names, logos, graphics, photographs, videos, designs and other materials, is owned by ESVlife or used with the permission of the respective rights holder.
Such content is protected by applicable Austrian, European Union and international intellectual property laws.
You may access and use our website for personal and lawful purposes.
You may not reproduce, distribute, commercially exploit, modify or publish protected website content without the consent of the relevant rights holder, except where permitted by law.
Third-party trademarks and other protected materials remain the property of their respective owners.
18. REVIEWS, FEEDBACK AND USER CONTENT
If you voluntarily submit a product review, comment, photograph or other content to us, you confirm that you have the necessary rights to submit that content.
You must not submit unlawful, defamatory, misleading, discriminatory, infringing or otherwise unlawful content.
Where you submit content for publication, you grant ESVlife the rights necessary to display, reproduce and technically process that content for the purposes for which it was submitted.
Any use of personal data contained in reviews or other submissions is subject to our Privacy Policy.
We may moderate or remove content where legally permitted, in particular where it violates applicable law, these Terms or the rights of third parties.
19. THIRD-PARTY SERVICES AND LINKS
Our online store is hosted and supported by Shopify and may use other third-party providers for services such as payment processing, shipping, analytics, customer communication or subscriptions.
Third-party websites or services may be subject to their own terms and privacy policies.
A link to a third-party website does not mean that we assume responsibility for content or services provided independently by that third party.
Nothing in this section excludes liability that cannot lawfully be excluded.
20. PRIVACY AND DATA PROTECTION
Personal data is processed in accordance with our Privacy Policy and applicable data protection law.

Our shop is hosted using Shopify services. Further information about the processing of personal data by us and relevant service providers is contained in our Privacy Policy.
21. PROHIBITED USE
You may not use our website:
• for unlawful or fraudulent purposes;
• to interfere with the security or technical operation of the website;
• to introduce malicious software or harmful code;
• to infringe intellectual property or other rights of third parties;
• to collect personal data unlawfully;
• to impersonate another person;
• to submit false or misleading information for fraudulent purposes; or
• to otherwise use the website in a manner prohibited by applicable law.
We may take reasonable measures to protect the website and other users from unlawful or abusive activity.
22. AVAILABILITY OF THE WEBSITE
We aim to keep our online store available and functioning properly.
However, temporary interruptions may occur due to maintenance, technical problems, security measures or circumstances outside our reasonable control.
Nothing in these Terms guarantees uninterrupted availability of the website.
This does not affect rights arising from a purchase contract that has already been concluded.
23. LIABILITY
ESVlife is liable in accordance with applicable law.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, nothing in these Terms limits mandatory liability for personal injury, intentional or grossly negligent conduct, product liability, statutory warranty obligations or other mandatory consumer rights.
For consumers, any limitation of liability contained in these Terms applies only to the extent permitted by mandatory consumer protection law.
24. FORCE MAJEURE
We are not responsible for delays or failure to perform contractual obligations to the extent caused by circumstances outside our reasonable control, provided that and to the extent such limitation is permitted by applicable law.
Such circumstances may include serious disruption of transport networks, natural disasters, governmental measures, widespread service outages or comparable events.
Statutory consumer rights relating to delayed or failed performance remain unaffected.
25. SEVERABILITY
If an individual provision of these Terms is invalid or unenforceable, the validity of the remaining provisions will not automatically be affected.
Mandatory statutory rules apply in place of any invalid or unenforceable provision where required by law.
26. APPLICABLE LAW
These Terms and contracts concluded through our online store are governed by Austrian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent such choice of law is permitted.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protection provisions that would apply under the law of the country in which you have your habitual residence.
Mandatory rules regarding consumer jurisdiction remain unaffected.
27. CHANGES TO THESE TERMS
We may update these Terms for future transactions where necessary, for example due to changes in our services, technical processes or applicable law.
The Terms applicable to an individual purchase are generally those provided or made available to you when the relevant contract is concluded.
Changes made after conclusion of a contract do not retroactively alter that contract unless this is expressly agreed or permitted by law.
